TERMS OF USE

These terms of use are a distance contract, set between SIA ASSAULT LURES, registration No. 40203642536, legal address: Miera iela 54a-14, Riga, Latvia (hereinafter referred as the Seller), which offers and sells goods on the assaultlures.eu website (hereinafter referred as the Store) to its visitors (hereinafter referred as the Buyer) in accordance with the Terms of use set out below.

GENERAL TERMS AND CONDITIONS

1.   The prices and main features of the goods sold in the Store are indicated next to each item. The prices of the goods are indicated in euros and include VAT. The price of the goods does not include delivery costs;

2.  If access to the Store is disrupted due to technical reasons or reasons beyond the Seller's control or access to the Store is impossible, the Seller is not liable for any losses incurred by the Buyer or third parties;

3.  The Seller has the right to unilaterally amend or supplement the Store content and the Terms of use at any time. Changes to the Terms of use come into effect after they are published in the Store's Terms of use section;

4.  When the Buyer makes a purchase in the Store, the Terms of use, in force at the time of ordering the goods, apply;

5.  Any communication between the Buyer and the Seller shall be in Latvian or English languages. If the Buyer does not speak one of these languages, he may use the help of translators or translation programs. The Seller is not responsible for inaccurately translated text and the consequences arising from it.

PLACEMENT OF ORDER

1.  To place an order, add the desired product to the shopping cart. Fill in all the required fields and select the most suitable delivery method. The total cost of the order, including delivery, is then displayed on the screen. To complete the order, it is necessary to make the payment;

2.  Before making payment, the Buyer must ensure that he has selected the correct goods and their quantity is appropriate;

3.  When placing an order, the Buyer undertakes to provide accurate information (name, surname, delivery address and contact information) and agrees to purchase the goods at the indicated price. If the Buyer has provided incorrect or false information, the delivery of the goods is not guaranteed;

4.  If the Buyer wants goods to be delivered to different addresses, then for each address the Buyer must place a separate order;

5.  By placing an order and making payment in the Store, the Buyer confirms that he has read and agrees to the Terms of use. The Buyer undertakes to read the Terms of use before each purchase;

6.  The Buyer can place orders in the Store 24 hours a day.

PAYMENT PROCEDURE

1.  The Buyer can pay for the goods using the payment tools built into the Store:

a.  Payments from the largest Baltic banks;

b.  Card payments;

c.  Google Pay;

d.  Apple Pay.

2.  Payment for the goods is considered completed when the full payment amount is received in the Seller's bank account;

3.  If the order cannot be fulfilled for any reason, the Buyer will be informed and the amount paid will be refunded as soon as possible, but no later than 14 days after sending the information.

TERMS OF DELIVERY

1.  Orders are processed on a first-come, first-served basis after full payment for the item has been made;

2.  Orders are processed, packaged and shipped on weekdays from 9:00 to 17:00 (Fridays from 9:00 to 16:00);

3.  The Buyer can choose one of the delivery methods implemented in the Store. Detailed information about delivery can be found in the Delivery section of the Store;

4.  The delivery costs of the goods are displayed in the shopping cart next to the delivery method;

5.  Delivery of goods is ensured only within the territory of the European Union;

6.  Any additional fees or taxes that may arise when receiving goods outside the Republic of Latvia shall be borne by the Buyer;

7.  The Seller ensures the delivery of the goods within 20 calendar days from the date of receipt of full payment for the goods. In exceptional cases, the Seller has the right to extend the delivery time of the goods up to 45 calendar days, informing the Buyer in advance;

8.  If the Store does not have the ordered goods or they are not in sufficient quantity, the Seller has the right not to deliver the goods or to deliver them in a smaller quantity, returning to the Buyer the difference paid for the undelivered goods;

9.  The Buyer must receive the goods themselves. If another person receives the ordered goods, then the order is deemed to have been received by the Buyer;

10.   If the Buyer has provided incomplete recipient details or if the goods are received by another person, the Seller is not liable for any losses;

11.   If the delivery of the goods cannot be carried out due to the fault of the Buyer or circumstances dependent on the Buyer, the goods will not be re-sent, but the money for the goods will be refunded, except for the payment for delivery and for damaged goods, if they were damaged during the return of the goods;

12.   The ownership rights to the ordered goods shall pass to the Buyer at the moment when the goods have been paid for in full and delivered in accordance with the Terms of use;

13.   The Seller may change and adjust shipping prices without prior notice.

RIGHT OF WITHDRAWAL

1.  The Buyer has the right to refuse the goods within 14 calendar days from the moment of their receipt by sending a letter of refusal to the Seller. The Seller sends the letter of refusal form to the Buyer by e-mail upon the Buyer's request;

2.  The Buyer is obliged to return the goods to the Seller no later than 14 days after sending the letter of withdrawal. All expenses incurred in connection with sending the goods back to the Seller shall be borne by the Buyer;

3.  The Buyer cannot exercise the right of withdrawal if the ordered goods are made specifically for the Buyer according to an individual order;

4.  The Buyer is responsible for maintaining the quality and safety of the product during the exercise of the right of withdrawal;

5.  The Seller reserves the right to refuse the Buyer the right of withdrawal or to withhold compensation fees in the event of:

a.  if the product is damaged due to careless handling of the product during use or failure to follow the instructions;

b.  if the original packaging of the product has been lost or the packaging has been significantly damaged;

c.  if the product has been used for a purpose other than to determine the nature, properties and operation of the product;

d.  if the product parts have been dismantled or if other parts have been added to the product;

e.  if the Buyer has not attached copies of invoice to the letter of refusal or the returned goods.

6.  The Seller shall refund the Buyer money for the product and its delivery costs within 14 business days after the Seller has received the returned product based on the Buyer's refusal;

7.  If the Buyer, when ordering the goods, has chosen a delivery method that is not the cheapest standard delivery method offered by the Seller, the Seller will not refund the delivery costs;

8.  If the Buyer has ordered several goods, but exercises the right of withdrawal for a number of goods that is less than the number in the order, the Seller will not refund the delivery costs;

9.  The right of withdrawal does not apply to purchases made by legal entities.

WARRANTY

1.  The Seller is liable for any non-conformity existing on the date of delivery of the goods that becomes apparent within 2 years from the date of delivery of the goods;

2.  The Buyer has the right to file a claim for non-conformity of the product 2 years after receipt;

3.  Warranty is valid, if:

a.  the product was used for its intended purpose and during use it was not modified and other parts were not added to it that could affect the service life of the product;

b.  the Buyer can present a proof of purchase (invoice);

c.  the item can be identified as being the same as that which was purchased and delivered;

4.  warranty is not valid, if:

a.  the Buyer, after using goods intended for use in water, did not dry them, as a result of which the goods corroded;

b.  the Buyer has used goods in salt water that are intended only for freshwater ;

c.  the product does not have its original packaging and it cannot be identified as one bought in the Store;

d.  the product has damage caused by the Buyer's fault;

e.  the item has been repaired by the Buyer or any other person;

f.    the product was modified, non-standard parts were added to it or the original fittings were dismantled;

5.  All expenses incurred in returning the goods to the Seller shall be borne by the Buyer;

6.  The Buyer must inform the Seller in writing about each warranty application;

7.  The Buyer has the right to a warranty if he submits a written application to the Seller no later than 2 calendar months after the defects in the goods are discovered.

PERSONAL DATA PROCESSING

1.  By entering the required information when placing an order, the Buyer confirms that he/she has read and agrees that the data provided by him/her is used so that the Seller can accept the Buyer's order and deliver the goods in accordance with the requirements of regulatory enactments. By entering the information, the Buyer agrees that notifications related to the processing of the Buyer's order will be sent to the specified e-mail address;

2.  The Buyer can find detailed information about the processing of personal data in the Privacy Policy section of the Store.

DISPUTE SETTLEMENT

1.  In matters not covered by the Terms of use and Privacy Policy, the Buyer and Seller undertake to comply with the regulatory documents in force in the Republic of Latvia;

2.  The Seller is not liable for any losses incurred by the Buyer in the event of a violation of these Terms;

3.  The Buyer and the Seller shall resolve all disputes arising between them through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the dispute shall be resolved in the Consumer Rights Protection Center or the Court of the Republic of Latvia;

4.  The Buyer may also turn to the European Union's dispute resolution bodies.
